Data privacy statement for Etopox online shop (www.etopox.ch; www.etopox.shop)
1. Preliminary remarks on data protection
Based on Section 13 of the Swiss Federal Constitution and the data protection provisions of the Swiss Confederation (Data Protection Act, DPA), every person is entitled to protection of their privacy as well as protection against misuse of their personal data. Walter Mäder AG complies with these provisions.
By visiting the websites and/or using the online shop Etopox (www.etopox.ch; www.etopox.shop, hereinafter individually and/or collectively “Etopox online shop”), the customer or online shop visitor acknowledges and agrees to these data protection provisions.
In cooperation with our service providers (e.g. hosting providers), we make every effort to protects the data to the best of our ability against unauthorized access, loss, misuse or falsification.

3. Data Processing
a) Visiting the Etopox online shop
Every time the online shop Etopox is called up, data and information from the end device (laptop, tablet, smartphone, etc.) of the customer or online shop visitor is automatically recorded. The following data is collected:
- Information about the browser type and version used
- The operating system of the customer or online shop visitor
- The IP address of the customer or online shop visitor
- Date and time of access
- Websites from which the system of the customer or online shop visitor is linked to the Etopox online shop
The storage and evaluation of this data helps Walter Mäder AG with online shop and offer optimization, error analysis and control of server capacity. This data also forms the basis for statistical, anonymous evaluations, so that trends can be identified, which Walter Mäder AG can use to improve its offers accordingly. This collected data is kept for up to one year until automated deletion.
b) Registration in the Etopox online shop / customer account and other data processing when visiting the Etopox online shop
When ordering in the Etopox online shop, the online shop visitor must register once as customer and define a user name and a personal password. For the implementation of the contract, the customer has to provide his name (first name, last name), address, telephone number, e-mail address and details of the payment method he wishes to use.
When visiting the Etopox online shop again, the customer can log in with his user name and password, which means that he does not have to enter his address and payment information again for each new order transaction. The password is stored in encrypted form and cannot be viewed by Walter Mäder AG. The data and information of the individual orders are also stored in the customer account.
The data stored in the customer account can be viewed by the customer at any time and changed by the customer independently. A copy of the original data is stored for traceability purposes.
The customer has the option to delete his customer account at any time, provided that no order is pending. The personal data required for proper accounting or other personal data that is subject to a statutory retention obligation and period, will be stored at least for the applicable statutory retention period. Walter Mäder AG deletes personal data that is not subject to a legal retention obligation at the request of the customer.
Furthermore, the customer or online shop visitor acknowledges and expressly agrees that Walter Mäder AG may store, process, retain, evaluate and use the data recorded in the course of the online shop visit or in the course of the contract for the purpose of fulfilling the obligations arising from the purchase contract (also outside the Etopox online shop) and for marketing and advertising purposes.
c) Use of Cookies
Walter Mäder AG uses cookies on the website www.etopox.ch and in the online shop in order to make the offers user-friendly for customers and online shop visitors. Furthermore, our web-shop processor Shopify (see section 2.) uses cookies (in this regard, we refer to Shopify's cookie policy at: www.shopify.de/legal/cookies).
Cookies are small files that are automatically created by the browser and stored on the end device (laptop, tablet, smartphone, etc.) of the customer or online shop visitor when he visits the Etopox online store. The cookies remain stored until the customer or online shop visitor deletes them. This enables Walter Mäder AG to recognize the browser of the customer or online shop visitor on the next visit.
If a customer or online shop visitor does not want this, he can set up his browser so that the browser informs him about the setting of cookies and the customer or online shop visitor can allow them in individual cases. However, Walter Mäder AG points out to the customer or online shop visitor that a deactivation leads to the fact that he cannot use all functions of the Etopox online shop.
d) Processing of data and personal data by third parties and cross-border disclosure
d1) General
Walter Mäder AG may have data and personal data processed by third parties insofar as this is necessary for the operation of the Etopox online shop or for the processing purposes stated in this data protection declaration. Furthermore, Walter Mäder AG may have the data and personal data necessary for the performance of the service (also outside the Etopox online shop) processed by commissioned service and logistics partners of Walter Mäder AG or by other third parties. In this context, the personal data and data are partly also disclosed across borders.
d2) Shopify
Etopox online shop works with Shopify Analytics, is hosted by Shopify International Limited. Personal data is sent abroad as part of the hosting process and is controlled by the Irish branch of Shopify International Limited. Data is sent to other Shopify locations and to service providers that may be located in other regions, including Canada (where Shopify International Limited is based) and the United States of America. d3) Payment Service Provider
For orders in the Etopox online shop, credit card or TWINT are offered as payment options via the service provider WORLDLINE. For this purpose, payment data may be transmitted to payment service providers cooperating with Walter Mäder AG. In the context of payment processing by credit card or TWINT, your credit card or TWINT data will be forwarded to Worldline Schweiz AG, Hardturmstrasse 201, 8005 Zurich and to the respective credit card company or TWINT. Further information on the processing of personal data by payment service providers can be found in their data protection guidelines.
4. Rights in Relation to Personal Data
You have the right to information and, if necessary, correction, revocation, restriction and deletion of the data concerning you. To exercise these rights, you must send an application to the e-mail address etopox@mader-group.com and prove your identity. Such applications shall be complied with to the extent required and permitted by law.

Walter Mäder AG makes every effort to ensure that the data and information in the Etopox online shop are correct, but accepts no liability for their correctness, accuracy, up-to-dateness, reliability, completeness and suitability for specific purposes; nor does it accept any liability for the constant or uninterrupted availability of the Etopox online shop, the functionalities, integrated links and further contents. Walter Mäder AG excludes liability and responsibility for any errors and/or omissions, and the consequences of the use of the information or the Etopox online shop. Liability claims against Walter Mäder AG, regarding damage of a material or immaterial nature arising from access to or use or non-use of the published information, through misuse of the connection or technical faults are excluded.
